Rental Terms

Before reserving a pontoon boat, please take some time to read our rental guidelines below. This will ensure you have an enjoyable experience on the water.

Renting a Pontoon boat

Each and every person who will be on the pontoon boat during the scheduled rental time must sign a waiver. The person responsible for signing the rental contract, waiver, and rental agreement is the sole driver and operator of the pontoon during that rental time. The pontoon boat must be operated in accordance with Federal, State, and local laws, rules, and regulations including, but not limited to all laws regarding the use of alcohol and drugs. DUI laws apply and are enforced by the ALEA Marine Patrol as well as other State, county and local law enforcement agencies. A copy of the Rental Agreement must be kept on the pontoon boat during the time of rental. The boat will accommodate 10 passengers. Picking up extra guests that exceeds the maximum after leaving Cappy's will result in a penalty payment, subject to the severity of the incident.
Please arrive for your rental 30 minutes prior to the scheduled departure time to ensure the entire rental time is allotted. Rental times cannot be extended due to late arrivals.
A security deposit of $100 per vessel will be required must be placed on a major credit card in the Renter’s name.

Age & License Requirements

The renter must be at least 25 years of age and the driver must have a valid driver's license. Prior boating experience is recommended but not required. If the driver has an Alabama driver's license and does not have a 'Vessel' endorsement, he/she will be required to attend a short safety briefing and must sign an additional document indicating they have been instructed in the rules regarding the proper and safe operation of the vessel. Boat Safety

  • Grilling is prohibited.
  • Pets are prohibited.
  • Towing or pulling anything other than skiers, tubes or floats is prohibited.
  • Fireworks and firearms (including flares) are prohibited.
  • Fishing and fishing equipment on the pontoon boat is prohibited.
  • All "no wake" zones must be honored.
Children under the age of 8 are required by law to wear a life jacket. Children sized life jackets are available upon request, however a life jacket for a child under the age of 3 must be provided by a parental guardian.
It is important to close and secure the front and back door with all riders inside before the boat begins moving.

Refueling

If you prepay for fuel, you do not need to return the boat full of fuel. Prepaying will save you money! If you do not prepay for fuel and do not return the boat with a full tank, we will retain your deposit.

Late Arrival & Cancellation Policy

A confirmed reservation will hold your vessel for up to 30 minutes after your scheduled departure time, after which it will be considered a "No Show" and the entire reservation fee will be forfeited.
When you arrive, the clock starts for your rental at the scheduled reservation time. Regardless of when you arrive, the pontoon boat must still be returned at the end of the designated rental time. This is to ensure the boat is available for the next scheduled rental.
At the end of the designated rental time, the pontoon boat must be returned cleaned. A late fee of $100 per half hour will be charged (and deposit will be retained) if the pontoon is not returned by the end of your rental period.

Littering

No trash or litter should be thrown from the boat. All trash must be secured within the pontoon boat to keep it from accidentally falling into the water. Upon return, all trash must be removed from boat and placed in the appropriate trash or recycling receptacles.

Payment

To reserve your boat, full payment and/or a $100.00 deposit is taken at the time of your reservation. Any damages or violations of the contract during the rental period will lead to additional charges and forfeiture of your deposit.

Damages

The driver or renter is responsible for all damages incurred during the rental period. The driver or renter must submit a credit card at the beginning of the rental for Cappy's to hold a deposit of $100. This deposit will be kept until the boat is returned. Any money owed to Cappy's due to damages incurred or violations of contract will be taken from this deposit at return of the rental. If no damages are incurred and the contract has not been violated, all money will be released upon the boat's return. A professional assessment of damages will be made to determine repair cost and the renter will be notified within five (5) business days. If any damages occur as result of the authorized driver or the party on the pontoon while the boat is on the water which results in needing a tow or Cappy's staff bringing you gas to refuel, a $100 charge will be applied. If the damage is due to negligence resulting in the boat being taken out of rental availability, you can be held responsible for both damages and revenue lost while boat is being fixed.

Cleaning Charge

If the boat is returned in a manner in which the boat will take extra effort to clean, there will be a cleaning charge of $100 added to your rental and will be taken from your deposit.

Inclement Weather Policy

There are no refunds for inclement weather conditions. If there are inclement weather conditions, guests can move their reservation to another day during the current season. Inclement weather is defined by the National Weather Service as high winds, lighting or thunder. Cappy's will determine the weather safety at our marina. If the weather turns severe while you are on the water, seek shelter immediately in a safe place or protected shoreline where you can anchor the boat. The weather in Alabama can turn bad quickly but luckily, it usually only lasts for a little while.
